			<content:encoded><![CDATA[<h4>Board Meetings</h4>
<p>Villas of Calavera Hills Homeowners Association Board Meetings are typically held on the  3rd THURSDAY of every month.  Meetings are held at Calavera Hills Community Center, 2997 Glasgow Drive, Carlsbad (<a href="http://thevillashoa.org/map">MAP</a>). Upcoming meeting dates are posted on the homepage of the website and meeting notices are posted on the kiosk near the mailboxes on Chatham approximately a week prior to the meeting.</p>
<h4>Board of Directors</h4>
<p>The Villas of Calavera Hills Homeowner Association Board of Directors is comprised of five members who are elected to two-year terms. Election rules are available on the <a href="http://www.thevillashoa.org/documents">Documents</a> page. Article IV Section 2 of the CC&amp;Rs and Article VII of the By-laws describe the role and responsibilities of the Board. Elections are typically held at the Annual General Meeting of the Association in July of each year. If you are interested in running for the Board please contact <a href="http://www.thevillashoa.org/management">ALLURE TOTAL MANAGEMENT</a>.</p>
<p>The volunteer Board of Directors is responsible for ensuring that the Villas of Calavera Hills remains a great place to live. This includes overseeing the many vendors who work for the Villas, including the management company, the maintenance crews, landscapers, and many more. The Board is also responsible for managing the Association&#8217;s finances and for enforcing the community&#8217;s CC&amp;Rs and rules and regulations. The Board of Directors is made up of Villas homeowners who volunteered to take on these responsibilities.</p>
<p>To contact the Villas of Calavera Hills Homeowners Association Board of Directors email <a href="../management">ALLURE TOTAL MANAGEMENT</a> and they will ensure that all communications received from Villas homeowners are forwarded to the Board in a timely manner. Please remember that some items may need to be addressed at the monthly board meeting so it may take up to 45 days to receive an official response from the Board.</p>

			<content:encoded><![CDATA[<h4>PLEASE OBEY PARKING RULES AND REPORT THOSE WHO DON&#8217;T</h4>
<hr />In recent months there has been a growing problem with parking violations at the Villas of Calavera Hills.  This is not only wrong as it breaks the rules but because it causes inconvenience for the majority of residents who observe the rules.</p>
<p>This page is an effort to summarize the sometimes complex rules.</p>
<p>All parking violations should be reported, in writing, to ALLURE TOTAL MANAGEMENT and should contain all the information listed below (see How Are The Rules Enforced).</p>

<h5>WHAT RULES ARE BEING BROKEN?</h5>
<p>The most common parking violations are:</p>
<ul>
<li>Residents (this includes homeowners, residents and room-mates) using the &#8220;guest only&#8221; parking spaces.  Residents are <span style="text-decoration: underline;">never</span> allowed to park in &#8220;guest only&#8221; parking spaces. Residents are only permitted to park in their assigned garage or assigned parking space.</li>
<li>Storage in garages.  The rules state you must have space to park a vehicle in your garage.</li>
<li>Vehicle maintenance in garages or parking spaces is <span style="text-decoration: underline;">never</span> allowed.  You may think there is no harm in doing maintenance work onsite but please remember you are just one of 222 residents and if everyone worked on vehicles at the Villas it would look more like a mechanics lot than a community of homes.</li>
<li>Parking in the roadway or in front of garages is <span style="text-decoration: underline;">never</span> allowed and is a public safety hazard as it may prevent firefighters from access if they need to respond to a call at the Villas</li>
<li>Parking in the assigned space of another resident.  Marked parking spaces are the deeded property of the homeowner and should only be used by the homeowner or resident assigned that space.</li>
</ul>

<h5>HOW ARE THE RULES ENFORCED?</h5>
<p>The rules must be enforced using the <a href="/wp-content/uploads/pdfs/VCHViolationPolicy.pdf" target="_blank">Violation Policy (January 2006)</a> which says the following steps must be observed:</p>
<ul>
<li>If you observe a violation of the rules then you must file a written complaint to Association Management Group which should be signed and dated and must contain <span style="text-decoration: underline;">comprehensive</span> information about the violation. Include ALL of the following:</li>
</ul>
<ul>
<li>Photo of the violation showing the license plate and location of the vehicle OR verification by a second person from another household</li>
<li>Exact nature of violation (eg Resident parking in &#8220;guest only&#8221; space)</li>
<li>Date and time of the violation</li>
<li>License plate number of the vehicle</li>
<li>Make and model of the vehicle</li>
<li>Color of the vehicle</li>
<li>Address or unit number of the person in violation of the parking rules (without this we cannot begin action to address the violation)</li>
<li>If known, the name of the person in violation</li>
<li>If known, whether they are a homeowner, tenant, guest or hired help</li>
</ul>
<ul>
<li>The violation must be <span style="text-decoration: underline;">verified</span>.  This may involve photographs in the case of parking violations or it can also be another homeowner witnessing the violation.  Unfortunately the Board cannot act on complaints that cannot be verified.</li>
<li>Upon receipt of a written complaint with verifiable information, Association Management Group will write a &#8220;Courtesay Notice&#8221; to the homeowner of record advising them of the violation</li>
<li>Allow about a week for the letter to get to the homeowner/resident and if the violation continues report the violation again, using the same steps outlined above</li>
<li>A &#8220;Second Notice&#8221; will be sent to the homeowner of record, upon verification of the violation</li>
<li>If the violation is not corrected within 2 weeks of the second notice then Association Management Group will send out a hearing notice advising that a fine will be imposed and that the homeowner has the right to a hearing.</li>
<li>A hearing before the Board of Directors will be held at the following Board meeting (held third Thursday of each month) and if the violation is upheld the homeowner will be fined</li>
<li>If the violation continues the Board will continue to impose fines and penalties as allowed by the Violation Policy</li>
</ul>
<hr />PLEASE NOTE: As a homeowner, if somebody parks in your <span style="text-decoration: underline;">assigned parking space</span> you have the right to have the car towed.  Towing requirements for Homeowner&#8217;s Associations are much stricter and make it difficult for the Association to tow a vehicle but homeowners can have vehicles towed from their own private space (only).</p>
<p>This process is lengthy and homeowners reporting violations should assume it could take six weeks or more before the Board can take action, assuming that the violation occurs at least three times and that the violation is accurately documented and reported to Association Management Group.</p>
<p>We need YOUR help to fix this problem.  Unless YOU (homeowners and residents) vigilantly record and report these problems the Board cannot do anything about them.  We want to make the Villas of Calavera Hills a more pleasant place to live and ask that you do all that you can to help us in this pursuit.</p>

<p>The Villas of Calavera Hills Homeowners Association is managed by Allure Total Management. They have been working with the Villas since September 2011. Allure TM provides assistance with the operation and maintenance of the Association and the common areas. This includes handling maintenance requests, processing monthly dues, assisting with the agenda and minutes for monthly board meetings, contract administration for our vendors, obtaining maintenance bids, provide 24-hour emergency services by phone, managing business records and financial records and many other services.</p>

<p><strong>MONTHLY ASSESSMENTS</strong></p>
<p>Association assessments (i.e. dues) are $300 payable monthly (as of 8/1/2011). Due dates are the first of the month. Assessment fees cover property management items like landscaping maintenance, pool service, water bills and trash removal. The operating budget outlines where the money is allocated, and can be viewed on the <a href="&lt;?php bloginfo('url'); ?&gt;/documents">Documents</a> page of this website. <p>Large repairs which may incur significant costs may need to be reviewed by the Board of Directors and therefore will not be addressed until the next board meeting. In most cases the person making the request will not be notified further unless there is a problem with that request. For non-emergency repairs this may take up to 45 days to be brought before the Board.</p>
<p>The scope of common area maintenance that the Association is responsible for is outlined in Article X of the Villas of Calavera Hills Homeowners Association CC&amp;Rs which can be found on the <a href="&lt;?php bloginfo('url'); ?&gt;/documents">Documents</a> page.</p>

Did you know that your HOA dues (currently $250 per month) pay for water consumption at the Villas? We all have an incentive to do what we can to save to keep our HOA dues low. <p><strong>2/12/2010 RECONSTRUCTION WEB UPDATES FROM GENERAL CONTRACTOR</strong> - The general contractor for the entry deck reconstruction project, Reconstruction Experts Inc, is hosting a web page with brief updates on the project. <p><strong>SPECIAL ASSESSMENT - NOTICE FOR HOMEOWNERS WHO PAY VIA EFT</strong> - Please note that if you pay your monthly homeowners dues via EFT (electronic funds transfer) that your $880 per month (for five months) special assessment payment <span style="text-decoration: underline;">will not</span> be automatically deducted. Please contact Association Management Group immediately if you have not mailed in your Special Assessment payment for January 2010. We apologize for any confusion caused to homeowners who pay via EFT.<strong></p>
<p>RECONSTRUCTION UPDATE - 1/17/10 - </strong>The Board is scheduled to approve a construction contract with Reconstruction Experts Inc at their January 21, 2010 Board Meeting. The first of the Special Assessment payments was due January 1, 2010. Construction is anticipated to begin in the first week of February 2010. The project will be completed in five phases. The first phase is on Winthrop and Seaside and may take 6 weeks. Homeowners on Winthrop and Seaside will hear from construction liaison Joannie Eide before construction begins and will be provided with information on the schedule and any distruption to entry to their homes. We understand that this will be a disruptive process and ask for your patience as construction occurs on your street.</p>
<p><strong>SPECIAL ASSESSMENT BALLOT UPDATE - 12/23/09 </strong><br />
The Special Assessment Ballot passed in November 2009 and a special assessment of $4400 will be levied on each homeowner at the Villas to pay for the Entry Deck Reconstruction Project (Phase II Part 2).  First payment of $880 will be due January 1, 2010 and the special assessment fee will be billed with your monthly homeowners association dues. Homeowners can pay in 5 equal payments or in a lump sum. If you are concerned that you cannot meet the payment schedule please contact <a href="mailto:sdamg@amg.net?subject=VCH - Special Assessment-Reconstruction">Association Management Group</a> <strong>in writing</strong> before January 1, 2010.  All homeowners are subject to the assessment and will be required to pay the full assessment but the Board will consider hardship claims on a case by case basis and <u>may</u> extend payment options for a limited number of homeowners.  Please note that an extended payment plan will result in additional fees attached to the special assessment.  Non-payment will result in action under the Villas <a href="/wp-content/uploads/pdfs/VCHCollectionPolicy.pdf" target="_blank">Assessment Collection Policy</a>.</p>
